2. Medical disclaimer
&Mind is a general wellness and educational product. It is not a medical device, has not been evaluated by the U.S. Food and Drug Administration, and is not intended to diagnose, treat, cure, or prevent any disease or health condition. The Brain Health Score, brain-age, and domain scores are wellness estimates relative to an age-based peer group; they are not clinical measurements and have not been validated against standardized neuropsychological instruments, and individual results vary and may be inaccurate. Do not use &Mind as a substitute for professional medical advice, and do not disregard or delay seeking professional care because of anything in the app. Using &Mind does not create a doctor-patient or other clinical relationship. Always consult a qualified healthcare provider with questions about a medical condition. If you think you may have a medical emergency, call your doctor or 911 immediately.
3. The service
&Mind provides self-administered cognitive assessments, recovery check-ins, and wellness insights. We may change, suspend, or discontinue features at any time.
4. Your account and acceptable use
You are responsible for keeping your account credentials secure and for activity under your account. You agree not to misuse the service, including by interfering with it, attempting unauthorized access, scraping, or using it in violation of law.
5. Intellectual property
&Mind LLC owns the &Mind app and its content. You retain ownership of the data you provide. We grant you a personal, non-transferable, revocable license to use the service.
6. Disclaimers and limitation of liability
The service is provided "as is" and "as available" without warranties of any kind. To the fullest extent permitted by law, &Mind LLC will not be liable for any indirect, incidental, or consequential damages arising from your use of the service.
7. Governing law and disputes
These Terms are governed by the laws of the State of Nevada, without regard to conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in Nevada, unless otherwise required by applicable law.
